This page states the Terms of Use under which you ("You" / "Your") may use billioncareers.in and its associated platforms — collectively referred to as "Hamara Suite" (alternatively the "Website") and/or the Mobile Application ("App") — an online service of Billion Careers Private Limited ("Company", "we", "our", "us"). The terms "You", "Your" and "User" refer to all individuals and entities accessing the Website/App for any purpose.

These Terms must be read in conjunction with and are subject to the Website Privacy Notice, which is incorporated herein by reference and forms an integral part of these Terms. If You do not agree to these Terms, the Company may be unable to provide certain or all services.

By accessing or using the Website/App, You represent and warrant that You have the legal capacity and authority to enter into these Terms and that You will use the Website/App in accordance with these Terms and all applicable laws, rules, and regulations.

The Website/App enables Users to access, register for, apply to, enroll in, subscribe to, purchase, offer, manage, or otherwise avail themselves of the services, opportunities, programs, products, benefits, courses, training, recruitment, human resource solutions, and other offerings made available through the Hamara Suite, subject to these Terms.

Permitted Use. You may use the Hamara Suite platforms solely for their intended purposes as described herein and in any applicable service documentation, subject to your compliance with these Terms and all Applicable Law.

Prohibited Conduct. You shall not, directly or indirectly:

• Use the Website/App to upload, post, transmit, distribute, store, or otherwise make available any content that is unlawful, defamatory, obscene, pornographic, abusive, harassing, discriminatory, hateful, misleading, fraudulent, invasive of another person's privacy, or otherwise objectionable.
• Impersonate any person or entity, misrepresent Your affiliation with any person or organization, introduce viruses, malware, or other harmful code, interfere with the operation or security of the Website/App, or engage in any activity that may disrupt or adversely affect the Website/App or its users.
• Attempt to gain unauthorized access to any portion of the Website/App, its systems, networks, servers, accounts, or data, nor attempt to circumvent any security or authentication measures.
• Use automated tools, bots, scripts, scrapers, crawlers, or similar methods to access, collect, extract, or index data from any Hamara Suite platform without prior written consent from BCPL.
• Use candidate or employee data accessed through the platforms for any purpose other than legitimate recruitment, HR management, or benefits administration.

The Company reserves the right to investigate any suspected violation of these Terms and may take appropriate action, including suspension or termination of access, removal of content, and cooperation with law enforcement authorities where required by applicable law.

When registering for or using the Website/App, You may be required to provide certain information about Yourself ("Information"). All registration information you provide will be accurate, current, complete, and not misleading. You will not create multiple accounts for the same individual or entity without prior written approval from BCPL.

You are responsible for maintaining the confidentiality of Your account credentials and for all activities conducted through Your account. You shall not share Your login credentials or otherwise permit any third party to access Your account. The Company reserves the right to suspend or restrict access in the event of any unauthorized sharing or misuse of account credentials. You shall promptly notify the Company of any unauthorized access to or use of Your account or any other suspected security breach.

You are solely responsible for any information, content, materials, communications, documents, or other data submitted, uploaded, published, displayed, or otherwise made available through the Website/App ("User Content").

By submitting User Content, You represent and warrant that You have the necessary rights, permissions, and authority to do so. You grant the Company a non-exclusive, royalty-free license to host, store, reproduce, modify, display, transmit, distribute, and otherwise process such User Content to the extent necessary to provide, operate, administer, maintain, improve, promote, and support the Website/App, the Hamara Suite, and related services.

The collection, use, processing, disclosure, retention, transfer, and sharing of personal information contained in User Content shall be governed by the Website Privacy Notice and Applicable Law. The Company does not guarantee the accuracy, completeness, legality, or reliability of any User Content and may, at its sole discretion, remove, restrict, or disable access to any User Content that it reasonably believes violates these Terms, applicable law, or the rights of any person.

The Company acts solely as a facilitator of the services, opportunities, programs, and interactions made available through the Website/App and is not responsible for any hiring, employment, admission, enrollment, engagement, benefit, commercial, or other decisions made by users or third parties through the Website/App.

Organizations, employers, institutions, service providers, and other business users shall comply with applicable laws in relation to any information obtained through the Website/App and shall implement reasonable measures to protect such information from unauthorized access, use, disclosure, alteration, or loss. Information obtained through the Website/App shall be used only for legitimate purposes connected with the services offered and shall not be misused, sold, or exploited in a manner that violates applicable law or the rights of any person.

Users, Employers, institutions, trainers, service providers, and other entities posting jobs, courses, programs, benefits, services, advertisements, or other offerings through the Website/App are solely responsible for the accuracy, legality, and content of such postings. Such postings shall comply with applicable law and shall not contain misleading, deceptive, discriminatory, unlawful, or inappropriate content, including content relating to illegal activities, sexual services, or content that unlawfully requests sensitive personal information from users.

The Company does not independently verify, endorse, or guarantee the accuracy, authenticity, completeness, quality, suitability, or legitimacy of any posting. Users rely on such information at their own discretion and risk.

User accounts are personal to the registered user and are provided solely for accessing and using the Website/App in accordance with these Terms. The Company retains control over the administration and operation of all accounts and reserves the right to suspend, restrict, deactivate, or delete any account in accordance with these Terms. The Company may deactivate or delete accounts that remain inactive for an extended period, subject to applicable law and the Company's record-retention requirements.

If You access or use the Website/App through a mobile device, certain information relating to Your device, network, location, and use of the Website/App may be collected, processed, and shared in accordance with the Privacy Notice.

You are responsible for maintaining accurate and up-to-date account and contact information, including any mobile number associated with Your account, and for any charges, fees, or permissions required by Your mobile carrier in connection with Your use of the Website/App. Use of any mobile application made available by the Company shall be subject to these Terms, the Privacy Notice, and any additional terms applicable to such mobile application.

All content available on the Website/App — including text, designs, graphics, images, videos, blogs, training materials, course content, software, audio files, logos, trademarks, button icons, data compilations, and other materials (collectively, the "Hamara Suite Content") — is owned by or licensed to the Company and is protected under applicable intellectual property laws.

Unauthorized use of the Hamara Suite Content is strictly prohibited. Except as expressly permitted by the Company, You shall not modify, reproduce, distribute, transmit, display, publish, publicly perform, create derivative works from, sell, license, or otherwise exploit any Hamara Suite Content in any manner that infringes the Company's intellectual property rights or other proprietary rights.

The Company respects the intellectual property rights of others and expects users to do the same. The Company reserves the right to remove any allegedly infringing content, suspend or terminate access, and take any other appropriate action. If You believe that any content available through the Website/App infringes Your intellectual property rights, You may submit a written complaint to the Company at marketing@billioncareers.in.

The Company does not warrant that the Website/App will be error-free, uninterrupted, secure, or free from viruses, malware, or other harmful components, nor does it guarantee any specific outcome, result, employment opportunity, admission, enrollment, engagement, benefit, or business advantage. To the fullest extent permitted by applicable law, the Company and its affiliates, directors, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunities, goodwill, data, or other intangible losses arising out of or in connection with the use of, or inability to use, the Website/App.

In relation to Hamara Jobs, the Company does not charge candidates any registration fee, security deposit, or similar payment in connection with recruitment opportunities, unless expressly stated otherwise by the relevant employer or service provider.

To the extent the Company is held liable under applicable law, such liability shall be limited to direct losses actually suffered and proven to have arisen from the Company's breach of these Terms or applicable law.

The Website/App may contain links to, integrations with, or references to third-party websites, applications, products, or services. Such links and references are provided solely for convenience and do not constitute any endorsement, approval, or recommendation by the Company.

The Company does not own, control, monitor, or assume responsibility for any third-party websites, applications, products, services, content, policies, or practices. Access to and use of any third-party website or service shall be subject to the applicable terms and privacy policies of such third party. Users who access or use any third-party service do so at their own risk.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, directors, officers, employees, agents, and representatives from and against any claims, actions, proceedings, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (i) Your use of the Website/App or the Hamara Suite; (ii) any User Content, information, or material submitted, uploaded, or made available by You; (iii) Your violation of these Terms, applicable law, or the rights of any third party; or (iv) any fraudulent, negligent, or wrongful act or omission by You.

Assignment. You may not assign, transfer, or otherwise dispose of any of Your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign or transfer its rights and obligations to any affiliate, successor, or third party in connection with a merger, acquisition, corporate restructuring, or transfer of business.

Dispute Resolution and Governing Law. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Hamara Suite platforms, the parties shall first attempt to resolve the matter amicably through good-faith negotiations within 30 days of one party notifying the other of the dispute.

If the dispute is not resolved within 30 days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, or failing agreement, appointed in accordance with the Rules of the Indian Council of Arbitration. The seat and venue of arbitration shall be Bengaluru, Karnataka, India, and the language of arbitration shall be English.

Notwithstanding the above, BCPL reserves the right to seek injunctive or other equitable relief from a court of competent jurisdiction to prevent or restrain breach of these Terms. Subject to the arbitration clause, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any matters not referred to arbitration.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. No failure or delay by the Company in exercising any right or remedy under these Terms shall constitute a waiver of such right or remedy.

Entire Agreement. These Terms, together with the Privacy Notice and any additional terms applicable to specific services, constitute the entire agreement between You and the Company regarding the use of the Website/App and supersede all prior communications or understandings relating to the same subject matter.

Amendment. The Company reserves the right to modify, update, or revise these Terms at any time. Any changes shall become effective upon publication on the Website/App or as otherwise communicated by the Company.
